§ 8 Waste oil collection point for delivery to end-users
(1) Anyone who commercially sells internal combustion engine oil or gear oil to end-users must, before delivery, set up a collection point according to paragraph 2 for such used oils or provide proof of such a collection point through an appropriate contractual agreement. When selling to private end-users, easily recognizable and legible signs at the point of sale must indicate the collection point according to paragraph 2.
(2) The collection point must accept used internal combustion engine oils or gear oils free of charge up to the quantity of internal combustion engine oils and gear oils delivered in the individual case. It must have facilities that allow for professional oil changes.
(3) If the collection point is not at the point of sale, it must be spatially related to the point of sale in such a way that its use is reasonable for the buyer.
(4) Paragraphs 1 to 2 apply mutatis mutandis to oil filters and oil-containing waste regularly generated during oil changes.
(5) Paragraphs 1 to 4 apply accordingly if remote communication means are used for the commercial sale of internal combustion engine oils and gear oils to end-users.
